Assessment is completed throughout the training day, marked internally, externally moderated by NEBOSH, and graded Pass or Refer.

Health and safety law in the UK does not stop at the shop floor. The Health and Safety at Work etc. Act 1974 places general duties on employers to protect employees and others affected by their operations, and Section 37 of that Act allows individual directors, managers and other officers to be prosecuted personally where an offence committed by the organisation was committed with their consent or connivance or was attributable to their neglect. Leadership failure, in other words, can carry personal legal consequences and not just organisational ones.

The Corporate Manslaughter and Corporate Homicide Act 2007 adds a further layer, allowing an organisation to be prosecuted where a gross failure in the way activities were managed or organised by senior management caused a death. Sentencing guidelines for health and safety offences also explicitly consider the culture an organisation’s leadership has created, including whether failings were systemic or a result of poor leadership example, when setting the level of any fine.

HSE itself has published guidance, Leading Health and Safety at Work (INDG417), setting out what it expects from boards and senior leaders specifically, distinct from what it expects from the wider workforce. The NEBOSH HSE Certificate in Health and Safety Leadership Excellence was developed jointly with HSE and reflects that same expectation: that leadership behaviour, not just policy documents, is what determines whether an organisation’s health and safety culture actually works in practice.

What is the difference between this course and the NEBOSH HSE Award in Managing Risks and Risk Assessment at Work?

The Award in Managing Risks and Risk Assessment at Work is a practical, technical qualification focused on how to carry out a risk assessment. The Leadership Excellence course does not cover risk assessment methodology at all. It is aimed at a different audience with a different purpose: understanding how leadership behaviour shapes whether risk is managed well across an organisation in the first place, rather than how to carry out the assessment itself.

Do directors have personal legal liability for health and safety failures?
